Kithwell Terms of Service

These Terms of Service ("Terms") govern your use of Kithwell, an app operated by Orbitia Labs LLC ("we," "us," "our"). By creating a Kithwell account or using the app, you agree to these Terms.

1. What Kithwell is — and isn't

Kithwell is a coordination tool for family caregiving circles: medication tracking, a shared calendar, a journal, and an emergency information summary (the "Binder").

Kithwell is not a medical device and does not provide medical advice. Information you and your circle enter — medication schedules, dosages, conditions — is exactly what you enter; Kithwell does not verify it against a pharmacist, physician, or drug database, and photo/OCR label scans always require your confirmation before anything saves. Always follow guidance from a qualified healthcare provider, and use the Binder's information only as a starting point in an emergency, not a substitute for professional medical judgment.

2. Accounts and care circles

You sign in with an email address using a one-time code — there's no password. You're responsible for keeping access to that email address secure. A "care circle" is a group of people (family members, aides, the person receiving care) who share access to one person's information. The person who creates a circle ("the organizer") can invite others and manage billing for that circle; other members join for free.

3. Pricing and billing

Kithwell offers a free tier that is genuine and indefinite — we will never retroactively hide or lock data you already had access to, whether or not you subscribe. Certain additional capacity (larger circles, a second care circle, aide/limited-role access, full history export, and similar) is available through a paid subscription, billed to the circle's organizer only. Pricing is shown in the app before you subscribe. Paid subscriptions renew automatically until cancelled; you can cancel at any time through your device's app store subscription settings, and cancellation takes effect at the end of the current billing period.

4. Your content

You and your circle retain ownership of the information you enter into Kithwell — medications, tasks, journal entries, photos, and Binder information. You grant us the limited right to store, process, and display that information back to your circle's members solely to provide the Kithwell service. See ourPrivacy Policy for how we handle this information, including what we never do with it (sell it, advertise against it, or share it beyond the service providers necessary to run the app).

5. Acceptable use

Don't use Kithwell to store or share information about someone who hasn't consented to being part of the circle (other than the standard case of an adult child or caregiver managing an aging parent's care with the family's knowledge), attempt to access another circle's data, or use the service for anything unlawful. The Binder's document vault is for paperwork related to your circle's caregiving needs — insurance cards, discharge summaries, a power-of-attorney document, and similar — not as general-purpose file storage unrelated to that purpose. Storage on a free circle is limited to 50MB; Kithwell Plus includes generous additional room for genuine use, subject to reasonable fair-use limits.

6. Disclaimers and limitation of liability

Kithwell is provided "as is." To the fullest extent permitted by law, Orbitia Labs LLC disclaims all warranties, express or implied, and is not liable for any indirect, incidental, or consequential damages arising from your use of the app, including any reliance on medication, scheduling, or emergency information entered by you or your circle. Nothing in these Terms limits liability that cannot be limited under applicable law.

7. Termination

You may stop using Kithwell at any time. You can permanently delete your account and its data directly in the app (Settings → Delete my account), or by contacting [email protected]. If you organize a care circle that other members still use, deleting your account removes your own access but leaves that circle and its data intact for the other members — there's no way to transfer organizer status yet. We may suspend or terminate accounts that violate these Terms.

8. Changes to these Terms

If we make material changes to these Terms, we'll notify active users by email before the changes take effect.
